In-Booth Sales: How to Do-It-Yourself (DIY)

with your own retail license or with a retail partner

The option to sell cannabis directly from your booth is now available to every exhibitor (except Craft booths). Selling directly from your booth at the show affords you more personal interactions with retail buyers and consumers, thus providing invaluable, instantaneous market research via face-to-face interactions.

What You Need to Know

Retail License

Conducting cannabis sales within your booth is equivalent to operating a small dispensary. Therefore all sales must be conducted by a licensed retailer, a licensed non-storefront retailer, or a licensed microbusiness that is authorized to engage in retail sales. Exhibitors can use their own retail license, or arrange to work with a licensed retailer of their choice.

Retail Employee(s)

Sales transactions in your booth may only be conducted by an employee of a licensed retailer. If you are working with a retail partner, they may provide you with 1-2 employees to handle in-booth sales for you. Alternatively, your retail partner can temporarily (for the duration of the show) hire 1-2 of your employees to conduct sales and then provide them with the required employee badges.

Your retail partner or retail employees should assist you in receiving Metrc transfers for your cannabis goods and recording sales after each day of the event.

Record Keeping

When planning your booth space and design, you and your retail partner must consider what equipment you would like to have in your booth to complete sales transactions.

For in-booth sales, you will need to keep records of your sales, either electronically at the time of purchase or recorded by hand and then provided electronically to the California Department of Cannabis Control via a METRC upload within 24 hours.

Recording sales by hand may be the easiest and most cost effective option for smaller booths, easing the overall need for processing power, while also serving as a fail-safe system in case of unforeseen issues with power failure or internet connectivity.

If space and design allow for it, you may opt to bring in a full service system, including a POS Station with iPad or computer, scanners, printer and printer paper, cash drawer, etc.

SOPs and best practices on how to manually record sales transactions in your booth will be provided in the Cannabis Guidelines.

Storage, Signage and Exit Packaging

To ensure compliance with California Department of Cannabis Control (DCC) regulations you will need to provide the following items in your booth:

  1. Secure, Locked Containers to store all cannabis goods for sale.

  2. A prominently displayed copy of your Retail License

  3. Employee ID Badges must be worn by your retail workers

  4. Opaque Exit Packaging must be supplied for all cannabis goods purchased by customers in your booth.

Invoicing and Tax Remittance

All cannabis goods provided to attendees at the event must be treated as a sale transacted by your retail partner.

For cannabis goods designated for sale on Day 1 (Industry Day), we recommend that you invoice your retail partner for a final wholesale price of $0.01 per unit. Those cannabis goods should then be sold to retail buyers for $3.00 per unit after taxes.

The retail price of your Cannabis Goods sold on Day 1 should be tax-inclusive. Therefore, your retail partner should include the excise tax on the wholesale price of the goods ($0.01 per unit), as well as applicable local and state taxes, for a final total of $3 per unit at sale.

For cannabis goods designated for sale on Day 2 (Festival Day), exhibitors and their retailer partners should work together to determine the wholesale price for direct-to-consumer sales and the retail markup—similar to regular dispensary flow.

Payment remittance of all taxes, including excise tax, sales tax, and local cannabis tax, will be the sole responsibility of the exhibitor's retail partner.

Distribution

All cannabis goods for sale must be transported by a licensed distributor or licensed microbusiness and comply with regulatory requirements.

You have the option to work with your own distributor to deliver your cannabis goods for sale to the Sonoma County Fairgrounds on Thursday, September 19th, or you can have your cannabis goods delivered to Nabis Distribution’s Los Angeles or Oakland warehouse one week prior to the event.
